General Terms and Conditions of Sale
These General Terms and Conditions of Sale (GTC) are intended to define the respective rights and obligations of the seller and the customer in connection with the sale of products by L’Atelier KokoroArt.
The seller is the sole proprietorship of L'Atelier KokoroArt operated by Noriko Betito.

1. General Provisions
The applicable GTC are those in force on the date the order is placed.
The Customer acknowledges having read these General Terms and Conditions of Sale in full prior to placing an order and accepts them without restriction or reservation.
The Customer declares that they are legally capable of entering into a contract under French law or validly represent the natural or legal person on whose behalf they are acting.
2. Products
The creations of L’Atelier KokoroArt are handmade following an artisanal and artistic approach.
Certain models may be produced in small series; however, each creation remains unique and is never strictly identical to another.
Photographs are provided for illustrative purposes only. As each handcrafted creation is made by hand, slight variations may occur.
Creations from L’Atelier KokoroArt must be handled with care and protected from humidity or prolonged exposure to water.
Creations including sumi-e works on paper, as well as paper or cardboard objects, are delicate handcrafted works requiring careful handling.
3. Prices
Prices are displayed in euros on the website www.kokoroarts.com.
As L'Atelier KokoroArt operates as a French micro-enterprise, VAT is not applicable pursuant to Article 293 B of the French General Tax Code.
The artworks are sold in mainland France and in the following European Union countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.
Shipping is free for orders over €200 to these destinations.
This offer does not apply to islands or European overseas territories.
The minimum purchase amount required for free shipping may be revised at any time.
For any other destination, please contact L’Atelier KokoroArt via the website contact form.
For orders shipped outside the European Union and/or to certain specific territories, customs duties, local taxes or import fees may be required by the authorities of the destination country. These charges remain entirely the responsibility of the Customer.
L'Atelier KokoroArt reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in effect at the time the order is confirmed.
4. Orders
Customers placing an order on www.kokoroarts.com must follow the procedure below:

Verification of the order details and possibility of correction before validation

Entry of the information necessary for delivery organization (delivery address, customer contact details, etc.)

“Proceed to payment”
The Customer will receive payment confirmation as well as an acknowledgment of receipt of the order by email.
The Customer must ensure the accuracy and completeness of the information provided when placing the order. L'Atelier KokoroArt declines all responsibility in the event of an input error or incomplete address resulting in a delay or impossibility of delivery.
L'Atelier KokoroArt reserves the right to refuse or cancel any order from a Customer with whom there is an ongoing dispute relating to the payment of a previous order.
All communications, orders and invoices constitute proof of the contract.
5. Custom Orders

The Customer will then receive a personalized quotation by email including:

mandatory 50% deposit amount.
Production will begin after receipt of the deposit payment and written acceptance of the quotation by the Customer.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for personalized creations made at the Customer’s request.
6. Availability
As the creations of L’Atelier KokoroArt are produced in small series or as unique pieces, their availability is automatically updated on the website.
7. Payment
All orders must be paid in full at the time of purchase.
Order processing will begin only after payment has been received.
Payment is made by credit card.
8. Retention of Title
The creations remain the property of L'Atelier KokoroArt until full payment of the order has been received.
9. Delivery
Products are delivered to the address provided by the Customer when placing the order.
Delivery times are provided as estimates only.
Shipping costs are indicated before the order is confirmed.
Once the order has been shipped, a tracking number may be provided to the Customer.
The Customer is required to check the condition of the parcel upon receipt and report any issue as soon as possible.
Force Majeure
L'Atelier KokoroArt cannot be held liable for any delay or impossibility of delivery in cases of force majeure, including strikes, natural disasters, war, transport disruptions or supply chain issues.
10. Right of Withdrawal / Returns
In accordance with applicable European legislation, the Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal.
Products must be returned in their original condition, complete and carefully packaged.
Return shipping costs remain the responsibility of the Customer.
Before any return, the Customer is invited to contact L’Atelier KokoroArt in order to organize the return process.
Customized or made-to-order creations do not benefit from the right of withdrawal, in accordance with applicable regulations.

The artworks offered for sale benefit from the legal guarantees provided under French law and applicable European regulations.
12. Intellectual Property
All content appearing on the website (texts, photographs, creations, illustrations and graphic elements) is protected by copyright law and remains the exclusive property of their respective authors.
Any reproduction, representation, distribution or use, in whole or in part, without prior written authorization, is prohibited.
13. Protection of Personal Data
Information collected during orders or exchanges through the website is used solely within the framework of the commercial relationship between the Customer and L’Atelier KokoroArt.

These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority before any legal action is taken.
